New Duties in the Sexual Violence and Harassment Action Plan Act: Remove the Guesswork

Description:

The new Sexual Violence and Harassment Action Plan Act (Bill 132) imposes a range of new duties in regard to workplace harassment.  These include requiring employers to amend their programs to implement workplace harassment policies and establish new rules for the investigation of workplace harassment incidents or complaints. 

However, the law is short on specifics as to how employers are supposed to comply.  The law does not provide guidance as to the scope of investigations, how they are to be conducted or how employers are to handle clearly frivolous complaints of harassment. 

Getting compliance wrong – either by “under-complying” or “over-complying” – raises the risk of legal liability and workplace disruption for employers.

Don’t rely on the internet or folks without legal training on how to comply with this important new law.  Receive expert guidance from experienced employment lawyers as to how your organization can comply with this new law painlessly and address workplace harassment effectively.

  • How your current workplace violence and harassment programs need to be revised;

  • What you need to report to employees who have allegedly experienced harassment;

  • Legal options for responding to harassment; and

  • How to deal with Ministry of Labour Inspectors if they do become involved.

You will also receive practical materials that you can use in your workplace, including a template workplace harassment program to comply with the new law and tools for conducting workplace investigations and preparing reports.
