IMPORTANT NOTICE:
This webinar will be held on Wednesday, February 26, 2020 and will run from 12 pm to 1 pm ET (including an interactive Q&A). Unique log-in instructions will be delivered separately in advance of the program.
Description:
An Ontario Court has departed from the historic approach of imposing fines against corporations by imposing a probation order not sought by the Crown or Defence. If this approach were widely followed, it would be a gamechanger for how corporations are sentenced under the OHSA and possibly other regulatory statutes. Please join us for a complimentary HR-Law Webinar on this new development, on Wednesday February 26, 2020 from 12:00 to 1:00 pm.
Topics to be covered:
- A review of sentencing provisions under the OHSA and the Provincial Offences Act;
- A review of cases that have imposed creative sentences against corporations in Ontario;
- What the new approach could mean for plea bargaining in Ontario under the OHSA;
- Why the approach of the Ministry of Labour is critical to this issue;
- How an Appellate Court might respond;
- “Creative” sentencing in other jurisdictions;
- Should “deferred prosecution agreements” be on the table?
